New Tools, New Rules: The Collision Industry Can’t Afford to Stand Still
by Sean Prestom, Managing Attorney, Coverall Law
It’s time for shops to stop playing by rules that were never written for them.
The Game Has Changed – But Most Shops Haven’t
Insurance companies are always changing. They adjust how they handle claims and payments all the time – sometimes every few months. They do this to save money, protect profits and keep their investors happy.
But most body shops haven’t changed. For many years, shops have been following the insurance companies’ rules. Instead of running the shop their way, they’ve been working around what the insurer wants. This has gone on for so long that many shops don’t even realize there’s another way.
Shops are still using old tools to fight new problems. They’re arguing the same things they argued 10, 20, even 30 years ago – things like labor rates, storage fees and repair procedures. The insurance companies have moved on. But the shops are still stuck in the past.
And here’s the hardest part: shops everywhere have adopted some assumption that it’s their job to deal with the insurance company for the customer. So they make calls, send paperwork and try to “work it out” with the insurer. But that’s not their job – and it puts the shop in a tough spot. It creates confusion, slows down payment, makes the repair harder than it needs to be, and it can even put safe repairs at risk.
It’s time for shops to stop playing by someone else’s rules.
The Insurer’s Playbook Keeps Changing – So Must Yours
Insurance companies have a plan. That plan includes slowing things down, saying “no” and not paying the full amount. They do it on purpose, because it saves them money. If a shop doesn’t have strong paperwork, clear systems and standards or legal help, the insurer’s plan usually works.
Insurance companies take advantage of confusion. If a shop isn’t sure about its prices, repair steps or how to explain them, the insurer will use that as a reason to push back. When a shop waits, hesitates or doubts, the insurer sees an opening – and they win by doing less.
But shops can win too – if they’re ready. Shops that are clear, prepared and protected don’t have to argue or beg. They stay in control. But that kind of strength doesn’t come from working harder. It comes from using the right tools, having the right systems and knowing the right strategy.
A Law Firm That Works Like the Shops It Serves
Most law firms don’t work well for body shops. They take too long to respond. They charge by the hour. They don’t understand how the collision repair business really works. And they often just react to problems instead of helping to prevent them.
Coverall Law is different – because we had to be. Many great attorneys and industry leaders helped us get here. We are thankful for their support and the knowledge they’ve shared. Their work helped build the base we now stand on, because so few lawyers in America know anything about the legal challenges of this industry and the areas of law it touches.
We based our start on moving away from the billable hour. Shops treat us like we are right down the hall, and they don’t have to worry about surprise bills. They can call us when they need help. That way, they get better answers, faster advice and stronger protection – without counting minutes.
More importantly, we compile and also share what we learn. We work with shops all over the country and learn what’s working and what’s not. Then we use that knowledge to help everyone. That way, our members don’t just get legal help – they get the benefit of a smarter, stronger network.
The Legal Foundation for Industry Evolution
Shops keep fighting the same fights. They argue about labor rates, storage, supplements and repair procedures again and again. But the real problem isn’t what they’re saying – it’s that they don’t have the right system to win.
For example, the Forever Forms are not just paperwork. They are living, breathing documents for the shops who employ them. They are built to protect the shop, clearly explain what payment is required and lay out how the insurer is allowed to be involved. These tools are tested and updated constantly, so they stay strong.
A tool like this helps a shop take control. They let the shop set the rules – how the job is approved, how prices are set and how to stop insurer delays. This means shops don’t have to wait or wonder. They lead from the start.
These tools must be built on real law. They are backed by legal strategies that can be enforced in court. That includes rights assignments, consumer protections and lessons learned from shops across the country.
We use the Forever Forms in every legal case and every call we take. They are the base for everything we do and our shops want to do. And we are always working to make them even better.
Learning Together, Getting Stronger
Every time a shop uses our legal tools, we learn something. Coverall Law works with shops all across the country. These shops do real repairs and deal with real insurers every day. What they see and share helps make the whole system better.
And as our advice keeps improving, we pay close attention to what insurers are doing, how courts are ruling and how our shops are doing. This means our help is designed to get stronger over time – so shops can stay ahead, avoid problems and defend their work.
It is important for a shop to avoid simply guessing, but instead having an approach that’s tested and real. We know what legal steps work best, we have seen them. And we know what doesn’t work. And we use that knowledge to make better solutions, give better advice, and support our member-shops every step of the way.
It’s Time to Take the Next Step
This isn’t about working harder. It’s about working smarter. The insurance companies keep changing how they do things. If your shop is still using the same old ways from 10 years ago, you’re falling behind.
Your shop deserves better. You should have clear rules, strong protection and full control over how you work. You shouldn’t be stuck trying to please the insurer or doing their job for them.
You have choices – but you need to act. You can get better tools. You can fix your paperwork. You can stop letting the insurer call the shots. But none of that happens unless you decide to change.
Coverall Law is here to help shops grow and take back control. It will never be our job to tell you how to run your business. But for those shops seeking to do the right thing for their customers, we give you the legal tools, support and guidance to run it your way.
